Holidays and Personal Time Off (PTO)

Texans Can employees who work less than 226 days are entitled to the holidays specified in your school calendar, which you can find on the Forms page. Bad weather days shown in school calendars will be considered holidays if unused, but if school is not held due to “bad weather,” then these days will not be holidays and employees will be expected to work.

The following are the regularly scheduled holidays for all employees: Labor Day, Thanksgiving Day and the day after Thanksgiving, Winter Break, Martin Luther King Jr. Day, Presidents Day, Good Friday, Memorial Day and Independence Day.

Employees accrue up to 10 days (80 hours) of personal time off (PTO) per year to each full-time employee, which accrues at a rate 3.33 hours per pay period. These hours roll over, but they are not transferable to other districts. You can use this time as needed, but it is recommended that you do so cautiously to allow for the days to accumulate in case of a personal emergency. Use of all personal leave should be approved by your supervisor before it is taken (except in the case of a medical situation or emergency where time does not allow for prior approval). A request for personal time off (PTO) should be given to your supervisor at least three days in advance. Please note PTO may be denied at certain critical times during the academic school year.

Non-Duty Days

Texans Can employees who work 226 days receive non-duty days. Non-duty days are not paid vacation. Each year the number of non-duty days fluctuates. For the 2020-2021 School Year there are 16 non-duty days, and for the 2021-2022 School Year there are 16 non-duty days.

As with all time off, use of non-duty days should be scheduled in advance and approved by your supervisor.

Teacher Retirement System of Texas

Texans Can Academies employees participate in the Teacher Retirement System of Texas (TRS) in lieu of Social Security (or FICA) contributions. Automatic payroll deductions of pre-tax salary are required of all eligible employees. This contribution is sent to the TRS and is generally matched by a state contribution for the account of the employee.

You can find your yearly and total contributions to TRS in the Employee Access Center (EAC) under "Deductions and Benefits" on the left-hand side.

For more information on the Teacher Retirement System of Texas, visit trs.texas.gov.

Family Medical Leave Act (FMLA)

To take FMLA leave, you must have worked for Texans Can Academy for 12 months. You can then provide your employer with appropriate notice. If you know in advance that you will need FMLA leave (for example, if you are planning to have surgery, you are pregnant or you need to care for an immediate family member), you must give your employer at least 30 days advance notice. Please email Olivia Ramirez at benefits@texanscan.org to request FMLA forms. If needed you can also visit dol.gov/agencies/whd/fmla for additional information on employee rights under FMLA.

Request for Accommodations under the Americans with Disabilities Act (ADA)

If you are currently disabled or become disabled during your employment, you should contact your manager and Human Resources to discuss reasonable accommodations that may enable you to perform the essential functions of your job.

Employees with questions or concerns relating to this policy should contact Benefits Coordinator Kathia Arriaga by email at karriaga@texanscan.org or by phone at 214-944-1995.

Workers' Compensation

Texans Can contracts with a third-party administrator to provide workers’ compensation insurance to protect employees who are injured on the job. Our workers’ compensation insurance provides medical, surgical and hospital treatment in addition to payment for loss of earnings resulting from work-related injuries. Injuries or illnesses sustained while working, no matter how minor you may think they are, should be reported to your supervisor and the Benefits Coordinator as quickly as possible but no later than 24 hours after you first experience the illness or injury. Doing so allows you to qualify for coverage as quickly as possible.

If you experience a work-related injury, fill out the Injury Report Form (available in English and Spanish) and send the completed form to Benefits Coordinator, Olivia Ramirez as soon as possible.

As a part of workers’ compensation coverage, employees are required to comply with treatment plans, work restrictions and third-party administrator guidelines.
